European Accessibility Act in Spain: what small online businesses need to know
How the EAA applies in Spain: the national law, who enforces it, the fines, the microenterprise exemption and the duties that catch small businesses out.
Last checked: 3 November 2026. Guidance, not legal advice.
The law
Ley 11/2023, Title I (accessibility), in force since 28 June 2025.
Who enforces it
Each autonomous community (and Ceuta and Melilla) designates its own authority; a national unit, the UTAC (Real Decreto 143/2026), coordinates them and takes citizen complaints.
Fines
- Ley 11/2023 sets no amounts itself: breaches fall under the relevant sector law or, failing that, the General Law on the rights of persons with disabilities (RDL 1/2013) — from €301 up to €1,000,000 for very serious offences, with possible exclusion from public aid.
Are small businesses exempt?
Microenterprises that provide services are exempt from the accessibility requirements and related duties (art. 3.3).
What to watch for
- Put the accessibility information in your general conditions or an equivalent document, in written and spoken form, and keep it up to date (art. 13).
- Tell the competent authorities if your service does not conform.
- Service contracts signed before 28 June 2025 may run until they end, for at most five years.
Not yet confirmed
We only state what we could confirm. These points still need checking against the official text:
- The Spanish text does not visibly define 'microempresa'; the EU directive's thresholds (fewer than 10 staff, at most €2 million) are reported by secondary sources only.
- Which authority each region has designated, and any regional sanction laws.
- The UTAC's online complaint form was announced but not yet live.
